In this week’s “Legal Lions” roundup, Law360 spotlighted Labaton Keller Sucharow’s historic and precedent setting victory in a high-profile data privacy case against Meta Platforms, Inc.  Following a two-week trial, on August 1, 2025, a California federal jury found Meta liable for its role in the unauthorized collection and commercial use of highly personal health data entered into the Flo Health app in violation of the California Invasion of Privacy Act.  The unanimous verdict marks a pivotal moment in consumer protection and data privacy law and stands as one of the first times a jury has held Big Tech accountable for its handling of consumer health information, helping to shape the future of data privacy.

As co-counsel for the plaintiffs, Labaton Keller Sucharow brought forward the powerful testimonies of five courageous women whose intimate health data entered into the Flo Health app was unknowingly shared with Meta and presented internal Meta communications and technical documentation suggesting that the company was fully aware it was receiving confidential health data from third-party app Flo Health and actively used it for advertising purposes.
