Labaton Keller Sucharow serves as Lead Counsel in a securities class action against Boston Scientific Corporation (Boston Scientific or the Company) and Company Executives (collectively, Defendants), alleging violations of Sections 10(b), 20(a), and 20A of the Securities Exchange Act of 1934 and Securities and Exchange Commission Rule 10b-5, on behalf of all persons and entities that purchased or otherwise acquired Boston Scientific publicly traded common stock between May 28, 2025 and February 3, 2026, inclusive (the Class Period).
Boston Scientific is a global medical technology company that develops and manufactures medical devices across a range of specialties. One of the Company’s most important growth drivers was its FARAPULSE Pulsed Field Ablation (PFA) system within its Electrophysiology (EP) business unit. FARAPULSE is a system used to treat atrial fibrillation and was launched commercially in the U.S. in January 2024. Boston Scientific was the first major PFA entrant in the U.S. market, and after the launch of FARAPULSE, the Company’s EP revenue exploded and more than quadrupled in two years.
On May 20, 2026, the Honorable Julia E. Kobick appointed Indiana Public Retirement System (INPRS) as Lead Plaintiff and Labaton Keller Sucharow as Lead Counsel. On July 20, 2026, Lead Plaintiff INPRS and Additional Named Plaintiffs Miami Fire Fighters’ and Police Officers’ Retirement Trust and Detroit General Retirement System filed an Amended Class Action Complaint (the Amended Complaint) alleging that Defendants made materially false and misleading statements concerning FARAPULSE’s competitive position and the sustainability of Boston Scientific’s EP growth. The Amended Complaint alleges that, even before the Class Period began, Defendants knew that FARAPULSE’s early success was not the product of superior technology, but rather, it was the temporary benefit of being first to scale in the U.S. PFA market, and that advantage had already eroded. According to the Amended Complaint, Defendants internally projected that it would lose significant U.S. PFA market share to its competitor, Medtronic, they tracked which hospitals switched from FARAPULSE to competitor’s products, and they received direct feedback that customers preferred competitor’s systems, all while assuring investors that FARAPULSE’s dominant leadership and growth were continuing unabated.
On February 4, 2026, when Defendants announced Boston Scientific’s fourth quarter and full-year 2025 results, revealing that the Company’s EP business had slowed materially, with U.S. EP revenue flat on a sequential basis from the third quarter of 2025. During the earnings call, Defendants admitted that the Company had “planned” and “expect[ed] to lose” PFA market share as competitors launched new products. On this news, the price of Boston Scientific stock plummeted, falling from a closing price of $91.62 per share on February 3, 2026 to $75.50 per share on February 4, 2026—a 17.6% decline, wiping out approximately $23.9 billion in market capitalization in the span of a single day. This was the Company’s largest single-day stock price decline since July 2000.
The case is In re Boston Scientific Corporation Securities Litigation, No. 1:26-cv-40075-JEK (D. Mass.). Defendants’ motion to dismiss the Amended Complaint is due in September and briefing will be complete by the end of the year. Labaton Keller Sucharow represents Lead Plaintiff Indiana Public Retirement System and serves as Lead Counsel for the Proposed Class.
