Labaton Sucharow Announces New Partners and Of Counsel

Labaton Sucharow announced today that Karin E. Garvey and David J. Schwartz have been elected to the Partnership and that John J. Esmay, Alfred L. Fatale III, Matthew Perez, and Elizabeth Rosenberg Wierzbowski have been promoted to Of Counsel, effective January 1, 2019.

 Recommended by The Legal 500, Karin Garvey represents businesses and public pension funds in complex antitrust class actions. She has nearly two decades of experience managing multijurisdictional cases from development through resolution and appeal. She has been key member of the teams litigating ISDAFix Price-Fixing Litigation ($504.5 million recovery), In re Foreign Exchange Benchmark  Rates Antitrust Litigation ($2.3 billion in recoveries to date), In re Opana ER Antitrust Litigation, and In re Generic Pharmaceuticals Pricing Antitrust Litigation.

David Schwartz focuses on event driven and special situation litigation using legal strategies to enhance clients’ investment return. His extensive experience includes prosecuting as well as defending against securities and corporate governance actions for an array of institutional clients including pension funds, hedge funds, mutual funds, and asset management companies. He played a pivotal role in the lawsuit against real estate service provider Altisource Portfolio Solutions, where he helped achieve a $32 million cash settlement. David has also done substantial work in mergers and acquisitions appraisal litigation.

John Esmay prosecutes complex securities fraud cases on behalf of institutional investors. He has helped secure significant victories in cases against Petrobras ($3 billion recovery) and Virtus Investment Partners ($22 million recovery). John was also a member of the pro bono team that helped secure asylum for a Pakistani national who was a victim of religious persecution in 2018.

Alfred Fatale III represents investors in cases related to the protection of the financial markets in trial and appellate courts throughout the country. He is currently litigating cases against ADT, Precision Castparts, Alexion Pharmaceuticals, and Tempur Sealy. Alfred is a member of the New York City Bar’s Financial Reporting Committee. 

Matthew Perez is a member of the Firm’s Antitrust and Competition Litigation Practice. His experience includes In re Treasury Securities Auction Antitrust Litigation, In re Capacitors Antitrust Litigation ($99.5 million in recoveries), In re Platinum and Palladium Antitrust Litigation, and In re Lidoderm Antitrust Litigation ($104.75 million in recoveries). While at the New York State Attorney General’s office, he received the Louis J. Lefkowitz Memorial Award for his work investigating bid rigging in the muni bond derivatives markets. 

Elizabeth Rosenberg is a member of Labaton Sucharow’s Settlement Group, where she focuses on obtaining approval of class action settlements, notice procedures and payment of attorneys’ fees. Liz has worked on the settlements for In re Massey Energy Co. Securities Litigation ($265 million all cash settlement), In re Computer Sciences Corporation Securities Litigation ($97.5 million all cash settlement), and In re Facebook, Inc., IPO Securities and Derivative Litigation ($35 million recovery). Her pro bono experience includes representing individuals seeking to obtain relief from the World Trade Center Victims’ Compensation Fund.
