On October 12, 2021, Judge James Donato of the United States District Court for the Northern District of California appointed Labaton Sucharow Partner Carol C. Villegas to serve as co-lead counsel in a consolidated data privacy litigation against fertility app maker Flo Health Inc, Facebook, Google, Flurry, and AppsFlyer.

Flo Health, the maker of an app that tracks menstrual cycles and collects sexual health information, is accused of sharing private medical consumer information with Facebook, Google, and others, without the knowledge or consent of its users.

The case, Frasco v. Flo Health Inc, Case No. 3:21-cv-00757-JD, consolidates multiple lawsuits filed against the company earlier this year, following a settlement between Flo Health and the Federal Trade Commission arising from similar claims.
