On October 13, 2021, Judge Robert S. Lasnik of the United States District Court for the Western District of Washington appointed Labaton Sucharow Partner Michael P. Canty to serve as co-lead counsel in a data privacy action against Amazon.com, Inc. and Amazon.com Services LLC (collectively, "Amazon") alleging that devices operating Amazon Alexa technology violate federal and state wiretapping statutes.

The class action stems from revelations that Amazon's Alexa technology surreptitiously recorded and saved recordings of millions of Americans without their knowledge or consent.

Mr. Canty co-led the litigation team that achieved the historic $650 million settlement in In re Facebook Biometric Information Privacy Litigation, No. 3:15-cv-9 03747-JD (N.D. Cal.) the largest cash consumer data privacy settlement ever, and one of the first cases asserting consumers' biometric privacy, among other notable matters.

The matter is Garner et al. v. Amazon.com, Inc. et al. No. 2:21-cv-00750-RSL (W.D. Wash.). Read the order here.
