Partner Jay Himes and Associate Jonathan Crevier authored an article for the spring edition of NY Litigator, “The Future Ain’t What It Used to Be”: Rigorous Analysis, Predominance and Other Developments in U.S. Class Actions. They survey a number of important Supreme Court and Circuit Court class action opinions from the past decade, pointing out that class certification motions have been receiving much closer judicial scrutiny than they did in years past and that class action litigants face more barriers than ever.
