Himes and Associate Tianran Song analyze the application of antitrust law to issues raised from the emergence of dynamic pricing algorithms in a recent article published in the February 2019 issue of CPI Antitrust Chronicle. The article, “Welcome to the Hotel California": The Beast of Algorithmic Pricing, discusses the implications of implementing dynamic pricing algorithms by examining algorithms used by ride-sharing applications and highlights potential disadvantages consumers may encounter because of any resulting coordination. The article also considers the limits of antitrust to deal with these circumstances and the need to look at alternative approaches when prevailing antitrust law does not provide an obvious answer.
