In Reuters, Labaton Sucharow Of Counsel Frank McConville examines how the SEC's case against Tesla and its CEO Elon Musk strengthens the Firm's class action lawsuit against the company filed on behalf of Citron's Andrew Left.
One benefit, Frank noted, is that "there have been previous cases in which judges have allowed shareholders' lawyers in private cases to incorporate facts from regulators' complaints." Frank also said that the SEC's action against Tesla is increasing the amount of interest in the already high-profile case. "This is by far the most newsworthy, buzzworthy case we've been involved with."
