Gregory Asciolla discusses key holdings in foreign price-fixing antitrust case
In a “solid victory” for the U.S. Department of Justice, the Ninth Circuit recently upheld a $500 million price-fixing fine against thin-film-transistor liquid-crystal display (TFT-LCD) panel manufacturer, AU Optronics, and the convictions of two executives.
Gregory Asciolla, Firm antitrust co-chair said, “It's really a further wake up call to companies doing business abroad that if they're going to fix prices, if they're going to engage in any anti-competitive activity involving products that enter the United States market, that they're going to be subject to [U.S.] antitrust criminal and civil laws. It's very helpful in clarifying the Foreign Trade Antitrust Improvements Act (FTAIA) from the Ninth Circuit's point of view."
