Halliburton Loss Causation Ruling to have Narrow Impact

The securities plaintiffs' bar, which has a remarkable run of success in recent Supreme Court decisions, had begun to make at least passing mention of loss causation in its arguments for class certification in recent years, even outside of the Fifth Circuit, said Labaton Sucharow LLP partner Christopher Keller. But Monday's ruling made it clear that those mentions were not necessary, because loss causation is not something judges will take into account at the class certification stage.
"I think you'll see that start fading away," Keller said.
