In re Packaged Ice Antitrust Litigation

Settled: February 22, 2011

The Court granted final approval of a $13.5 million partial settlement with defendant Home City Ice, who pled guilty to the conduct alleged in the complaint.

On March 10, 2008, Labaton Sucharow filed the first antitrust class action lawsuit on behalf of a proposed class of plaintiffs who purchased packaged cubed, crushed, block and dry ice directly from defendants, certain manufacturers of these products, including Reddy Ice Holdings, Inc., Arctic Glacier Inc. and Home City Ice Company.

Plaintiffs allege that, between January 1, 2002 and the present, defendants illegally conspired to fix the prices of and divide the market for packaged ice in violation of Section 1 of the Sherman Act. The case is pending before the Honorable Paul D. Borman in the Eastern District of Michigan.

Plaintiffs' Consolidated Class Action Complaint was filed with the Court on September 15, 2009. The Court denied defendants' motion to dismiss on August 2, 2010.
