Historic Recoveries for Institutional Investors

Since the passage of the Private Securities Litigation Reform Act of 1995 (PSLRA), Labaton Sucharow has placed special emphasis on the representation of public and private institutional investors as lead plaintiffs. As a result, we have been retained by numerous institutional investors and appointed as lead counsel in many high profile cases brought after the enactment of the PSLRA, including In re Bristol-Myers-Squibb Securities Litigation; In re American International Group Inc. Securities Litigation; In re HealthSouth Securities Litigation; and In re St. Paul Travelers Securities Litigation.

Extraordinary recent settlements achieved by us on behalf of our clients confirm that institutional investors acting as lead plaintiffs will enhance the ultimate recovery for themselves and other class members. For instance, we secured one of the largest securities class action recoveries in history as lead counsel in the In re Waste Management, Inc. Securities Litigation, obtaining a settlement for $457 million. In a public announcement following the settlement, the Connecticut State Treasurer remarked that “we achieved more money in less time at a lower cost than in any previous class action case in U.S. history.”


Breaking New Ground

In addition to winning substantial monetary recoveries for our clients, we have achieved innovative corporate governance reforms through innovative settlements that create permanent remedies to prevent future harm. In In re Waste Management, Inc. Securities Litigation, for example, we negotiated corporate governance measures to strengthen the role and independence of the audit committee, improve board accountability, and protect whistleblowers.

The Firm is a member of the Council of Institutional Investors, one of the premier U.S. shareowner-rights organizations, and Firm attorneys are regularly invited to speak at seminars dealing with securities litigation.

In addition to their work in the trenches of complex securities litigation, our attorneys serve as prominent leaders in the field. By way of example, one of our senior partners is President of the Institute for Law and Economic Policy, which over the last decade has become a preeminent voice in civil litigation and corporate reform—producing scholarly articles and analyses cited by judges among many others. Others have served as chairman of the Class Action Committee of the Commercial and Federal Litigation Section of the New York State Bar Association—one for over ten years. Our attorneys include an expert in e-discovery who is a member of the Steering Committee of The Sedona Conference Working Group on Electronic Document Retention and Production and has contributed to the drafting of a number of The Sedona Conference publications.
