In re Chocolate Confectionary Antitrust Litigation
Labaton Sucharow represents Plaintiffs who include confectioneries, wholesalers, and consumers who directly purchased chocolate and allege that Defendant chocolate manufacturers participated in a  conspiracy to fix prices of chocolate at above-market levels, in violation of the federal antitrust laws. This multidistrict class action litigation is pending before the Honorable Judge Christopher C. Conner in the Middle District of Pennsylvania.

Plaintiffs allege that Defendants have been colluding for years, through emails, phone calls, and in-person meetings, to set supracompetitive prices for their products. Defendants include all of the biggest players in the worldwide chocolate market. As alleged, these raised prices were not a reflection of increased costs, but of Defendants’ unlawful efforts to maintain or increase profits which had been declining.

On July 14, 2008, Labaton Sucharow was appointed to the Executive Committee of Plaintiffs' counsel for the direct purchasers.
