Animalfeeds International Corp. et al. v. Stolt-Nielsen SA
In the arbitration Animalfeeds International Corp. et al. v. Stolt-Nielsen SA, et al., Labaton Sucharow serves as Co-Lead Counsel, on behalf of a proposed class of direct purchasers of parcel tanker shipping services and represents Animalfeeds International Corp. Plaintiff alleges Defendants engaged in a global cartel and conspiracy to restrain the world market for parcel tanker shipping services, which caused the Plaintiff and the proposed class to pay supracompetitive prices for the transportation of bulk liquid chemicals, edible oils, acids, and other specialty liquids. Many of the Defendants have pleaded guilty to the alleged anticompetitive conduct and paid substantial fines in connection therewith. The arbitration panel unanimously issued a Partial Final Clause Construction Award on behalf of Plaintiff, thereby allowing the arbitration to proceed as a class arbitration. The Defendants moved to vacate the award and recently their motion was granted. Stolt-Nielsen SA et al. v. Animalfeeds International Corp. et al., 2006 WL 1750093 (S.D.N.Y. June 26, 2006). The District Court’s decision is on appeal to the Second Circuit Court of Appeals.
