By focusing a significant part of their questioning on the stages of the class certification process, the justices seemed more intent on simply tightening up securities class actions, according to Thomas Dubbs, securities litigation partner at Labaton Sucharow LLP.
"It was not clear that there was any groundswell to overturn Basic," said Dubbs.
