Ford, Automakers Ask JPML to Move Air Bag Suits to Pa.

Lawrence A. Sucharow comments on automakers’ request to move the Takata airbags case to the Western District of Pennsylvania
The group of automakers, including American Honda Motor Co. Inc., BMW of North America LLC, Subaru of America Inc. and others, filed a motion favoring a multidistrict litigation in Pennsylvania, arguing that both of Takata’s U.S. subsidiaries have headquarters, testing and manufacturing facilities nearby, and all the other U.S. defendants have headquarters or substantial facilities in the vicinity.
They also argued that Pittsburgh is centrally located and cost-effective and that the district’s caseload isn’t too heavy and has the fewest pending cases or weighted filings compared with the other proposed venues.
“We don’t think that they have come even close to meeting the burden showing that the Western District of Pennsylvania has any rational connection with the adjudication of this case,” Firm chairman Lawrence Sucharow said, adding that they will be filing a response to the motion in the next few days.
