Law360  Again Names Labaton Sucharow Class Action Practice Group of the Year

NEW YORK (January 8, 2016) – Labaton Sucharow LLP is pleased to announce that the Firm has once again been honored by Law360 as a Class Action Group of the Year. Winning firms were selected “based on the significance of the litigation wins or deals worked on; the size and complexity of the litigation wins or the deals worked on and; the number of significant, large or complex deals the firms worked on or lawsuits the firm had wins in.”

Noting the Firm’s, “dogged work in the preliminary stages of bringing a case, long before the first complaint is filed,” a profile on the Firm published in Law360 dove into a selection of the Firm’s big cases from 2015 as well as some of its unique attributes.

“Something that distinguishes our Firm from others is having the resources and expertise to not only uncover unlawful anti-competitive conduct, but to develop that into a viable pleading and file something in federal court that our competitors look to file their own cases,” said Gregory Asciolla, Co-Chair of the Firm’s Antitrust and Competition Litigation Practice.

According to Securities Litigation Practice partner Jonathan Gardner, “It’s imperatively important in our cases to have a robust prefiling investigation to plead a case that has all the elements to satisfy heightened pleading standards of the PSLRA. We have to do that without any discovery. Judges are holding us to a high standard.”

Lauding the Firm’s efforts that have “yielded in substantial recoveries,” Law360 touched successful cases including those against Fannie Mae, CVS, Freeport-McMoRan Copper & Gold, Credit Suisse, and Weatherford Ltd., as well as an antitrust action in a global price-fixing scheme across several airlines.

Looking ahead, partner Thomas A. Dubbs remarked on an upcoming case against social media behemoth, Facebook, concerning its headline-making initial public offering (IPO), “It’s a huge IPO and one that is virtually unique in American financial history in that the company revised its earnings estimate downward after the beginning of a road show.”
