Labaton Sucharow LLP Appointed Co-Lead Counsel in Class Action Against DuPont
NEW YORK (January 11, 2012)— Labaton Sucharow LLP was appointed co-lead counsel in In re Imprelis Herbicide Marketing, Sales Practices and Products Liability Litigation, case 2:11-md-02284-GP. Labaton Sucharow filed the first class action lawsuit in the county on behalf of lawn care professionals and property owners against E. I. du Pont de Nemours and Company ("DuPont") for damage to trees caused by DuPont's herbicide Imprelis®.
Plaintiffs allege that, between October 4, 2010 and the present, DuPont misrepresented the safety of Imprelis® to consumers and concealed or omitted the fact that Imprelis® caused serious environmental damage to trees, particularly Norway and Colorado spruce, white pines, and other evergreens. Furthermore, the action charges DuPont with consumer fraud, unjust enrichment, negligence, product liability and damage to land.
The case is currently pending before the Honorable Judge Gene E.K. Pratter in the Eastern District of Pennsylvania.
